NOTICE TO CEASE AND DECIST THE INFRINGEMENT OF A COPYRIGHT

To whom it might concern,
This letter is written on behalf of Mr. Saman Beigi, the author and copyright owner of the song “To Mahi”. Under sections 106 and 106(A) of title 17 of the United States Code, the copyright owner has certain exclusive rights as to the copyrighted work. These rights include, but are not limited to the right to claim ownership of the work and prevent audio transmission of such work.
This song has repeatedly been transmitted over the airwaves by your organization in the past, without the consent of the copyright owner. According to section 501 of title 17 of the United States Code, anyone who violates any of the exclusive rights of the copyright owner as provided by Sections 106-122, including those rights mentioned above, is an infringer of the copyright.
Please note that a copyright infringer will be liable for any damages caused to the copyright owner as the result of the infringement, according to section 504 of the title. Moreover, the copyright owner is entitled to restitution of any profits gained by the copyright infringer through his/her infringement of the work.
Section 505 of the title provides that the infringer shall be liable for the copyright owner’s costs and attorney’s fees in the event of a lawsuit. Mr. Saman Beigi, as the copyright owner of “To Mahi”, reserves all the rights as provided by this section to bring a lawsuit against your organization for the infringement of his work.
You should also be aware that section 506(a) of the title, in addition to the above mentioned remedies, states that anyone who willfully infringes a copyright shall be punished as provided under section 2319 of title 18, if the infringement was committed for purposes of commercial advantage OR private financial gain. The penalties under section 2319 of title 18 include a maximum imprisonment of 5 years and a fine of up to $2,500. Please know that it is widely deemed that unauthorized radio broadcast of a copyrighted work, is for commercial purposes. In addition, any future broadcast of the above mentioned work shall be deemed willful, since you have hereby been notified that Mr. Saman Beigi wishes to exercise his right to prevent you from transmission of this work in any shape or form.
